LIMITED WARRANTY ON BALLISTIC GLASS

THIS LIMITED WARRANTY GIVES YOU SPECIFIC LEGAL RIGHTS AND YOU MAY ALSO HAVE OTHER RIGHTS, WHICH VARY FROM STATE TO STATE.
THE LIMITED WARRANTY CAN ALSO BE FOUND ONLINE AT WWW.ARMOREDCYERGLASS.COM/WARRANTY OR IN THE DOCUMENTATION WE PROVIDE WITH THE PRODUCT.

WE WARRANT THAT DURING THE WARRANTY PERIOD, THE PRODUCT WILL BE FREE FROM DEFECTS IN: (1) MATERIALS AND WORKMANSHIP AND (2) BALLISTIC PERFORMANCE.

WE LIMIT THE DURATION AND REMEDIES OF ALL IMPLIED WARRANTIES, INCLUDING WITHOUT LIMITATION THE WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE TO THE DURATION OF THIS EXPRESS LIMITED WARRANTY.

SOME STATES DO NOT ALLOW LIMITATIONS ON HOW LONG AN IMPLIED WARRANTY LASTS, SO THE ABOVE LIMITATION MAY NOT APPLY TO YOU.

OUR RESPONSIBILITY FOR DEFECTIVE GOODS IS LIMITED TO REPAIR OR REPLACEMENT AS DESCRIBED BELOW IN THIS WARRANTY STATEMENT.
WHO MAY USE THIS WARRANTY?
Armored Cyber Glass, LLC, located at address 407 Lincoln Road, PH-NE, Miami Beach, FL 33139 (“we”, “us”, or “our”) extend this limited warranty only to the consumer who originally purchased the product (“you”) (collectively, you and us are referred to herein as “parties” or “ourselves”). It does not extend to any subsequent owner or other transferee of the product.

WHAT DOES THIS WARRANTY COVER?
This limited warranty covers: (1) defects in materials and workmanship of the ballistic glass, specifically including delamination or fogginess resulting directly from production-related workmanship (the "product"); and (2) the ballistic performance of the product; for each of the respective Warranty Periods for warranties (1) and (2) of this section, as is further defined below.

WHAT DOES THIS WARRANTY NOT COVER?
This limited warranty does not cover any damage or defects relating to, resulting from, or caused by: (a) transportation; (b) storage; (c) improper use or handling; (d) failure to follow the product instructions or to perform any preventive maintenance; (e) any modifications of any kind which are not expressly approved by us in writing, including but not limited to the use of sealants, adhesives, reflective films, or other materials; (f) repairs or inspections not authorized by us or performed by us; (g) normal wear and tear, including but not limited to scratches, abrasions, chips, or other defects occurring after the delivery of the product; (h) external causes such as accidents, abuse, or other actions or events beyond our reasonable control; and (i) failures or issues related to the raw materials used in the manufacturing of the product or from the manufacturing process of such raw materials.

Specifically with respect to our limited warranty of the ballistic performance of the product, this limited warranty does not cover any damage or defects due to: (1) failures which occur under conditions other than those consistent with the National Institute of Justice (“NIJ”) ballistic standard 0108.01 IIIA, current as of the date you purchased the product, including but not limited to those NIJ standards relating to high-speed 9-millimeter ammunition; and (2) failures which occur under conditions other than those consistent with UL 752 Level 6 ballistic standards, current as of the date you purchased the product, including but not limited to standards relating to two-inch distance requirements for shot-to-shot and shot-to-edge ballistics.

WHAT IS THE PERIOD OF COVERAGE?
This limited warranty starts on the date of delivery of the product to you and lasts for a period of: (i) one (1) year, for defects in materials and workmanship as described above, and (ii) five (5) years, for ballistic performance of the product (collectively, the “Warranty Period”). The Warranty Period is not extended if we repair or replace the product. We may change the availability of this limited warranty at our discretion, but any changes will not be retroactive.

WHAT ARE YOUR REMEDIES UNDER THIS WARRANTY?
With respect to any defective product during the Warranty Period, we will, in our sole discretion, either repair or replace such product (or the defective part) free of charge; provided, however, that such repair or replacement is subject to the Sales Agreement you sign with us (if applicable), and the terms of our Return Merchandise Authorization (“RMA”) processes and policies. You will be responsible for paying any costs and expenses related to labor for installation of the replacement or repaired product, shipping and handling, travel, or similar transportation expenses relating to any approved repair or replacement if we elect to repair or replace the defective product.

HOW DO YOU OBTAIN WARRANTY SERVICE?
To obtain warranty service, you must email our Customer Service Department at contact@armoredcyberglass.com during the Warranty Period to obtain an RMA form. No warranty service will be provided until your submission of our RMA form, which must completed by you in its entirety, including providing to us verifiable documentation of the claimed defect relating to your warranty service claim. Upon our receipt acceptance of your RMA form, if we approve your warranty service claim and elect to repair or replace the defective product, we will assign an RMA number to your warranty service. All warranty service requests must adhere to the warranty claim procedures set forth herein and on the RMA form, and are further subject to the Sales Agreement between you and us.

LIMITATION OF LIABILITY
THE REMEDIES DESCRIBED ABOVE ARE YOUR SOLE AND EXCLUSIVE REMEDIES AND OUR ENTIRE LIABILITY FOR ANY BREACH OF THIS LIMITED WARRANTY. OUR LIABILITY SHALL UNDER NO CIRCUMSTANCES EXCEED THE ACTUAL AMOUNT YOU HAVE PAID TO US FOR THE PRODUCT, NOR SHALL WE UNDER ANY CIRCUMSTANCES BE LIABLE FOR ANY CONSEQUENTIAL, INCIDENTAL, SPECIAL OR PUNITIVE DAMAGES OR LOSSES, WHETHER DIRECT OR INDIRECT, INCLUDING BUT NOT LIMITED TO: (A) THE NULLIFICATION, VOIDING, OR INVALIDATION OF ANY THIRD PARTY WARRANTIES; (B) YOUR BREACH OF ANY AGREEMENTS WITH ANY THIRD PARTIES; (C) IMPAIRMENT OF THE USE, VALUE, OR SAFETY OF ANY VEHICLE OR OTHER PROPERTY OWNED BY YOU WHICH IS USED WITH, INTEGRATED WITH, OR RELATED TO THE PRODUCT; AND (D) ANY personal or psychological injury, illness, pain, suffering, temporary or permanent disability, death, property damage, or financial loss arising out of or attributable to THE PRODUCT OR YOUR USE OF THE PRODUCT.

WHAT CAN YOU DO IN CASE OF A DISPUTE WITH US?

The informal dispute resolution procedure set forth below is available to you if you believe that we have not performed our obligations under this limited warranty. You must send written notice to us of any dispute relating to this limited warranty (a “Dispute Notice”). Following your Dispute Notice, both you and we agree to negotiate in good faith to attempt to resolve any dispute, including no less than two (2) negotiation sessions attended by you and our appointed representative, and occurring within sixty (60) days of our receipt of your Dispute Notice. You must use this informal procedure before pursuing any legal remedy in the courts.
